Carl joined Beijing Qianmu IP Firm in 2019, specializing in both contentious and non-contentious trademark matters. His practice covers trademark clearance, registration, review of refusals, opposition, invalidation, non-use cancellation, administrative litigation and review, as well as drafting and reviewing legal documents related to trademark strategy and brand protection.

In addition to trademark prosecution, Carl also provides legal consultation on trademark infringement and unfair competition, including domain name disputes, ICP license and filing, and copyright registration. With extensive experience and solid capabilities, he offers clients comprehensive and practical IP solutions.

• For instance, while representing a North Macedonian construction company, Carl discovered prior trade connections between the opposed mark and a Chinese enterprise. He successfully coordinated with that company to gather supporting evidence and even facilitated contact with other rightful brand owners whose marks had been preemptively filed by the same registrant—resulting in a unified opposition effort with increased impact.

Invalidation
With extensive experience in invalidation proceedings, Carl has gained deep insight into the examination standards and decision-making logic of the CNIPA.

• Representing a historic Italian manufacturer(founded in 1921) with no presence in China, he meticulously analyzed the registrant’s portfolio and filing patterns, constructing a compelling argument to block a bad-faith filing and protect the client’s brand rights in China.

Non-Use Cancellation
Non-use cancellation for three consecutive years(short as NUC) is a strategic tool against trademark hoarding and bad-faith registrations. Success hinges not only on evidence collection but also on understanding enforcement trends and policy shifts.

• In one case, Carl helped a Spanish client overcome a registration obstacle by negotiating a mutually beneficial arrangement with the Chinese agent of a conflicting registration. His pragmatic and cooperative approach led to a win-win outcome and exemplified how rational dialogue can resolve conflicts in today’s competitive IP environment.
